Tier 1 (Entrepreneur) settlement

If you have a Tier 1 (Entrepreneur) visa, you may be able to apply for settlement (ILR) in the UK if you have been living in the UK for 5 years or more.

Please note that this is not the same as Tier 1 (Entrepreneur) accelerated settlement, which would enable you to apply for ILR after 3 years of living in the UK under permitted circumstances.

Eligibility:

If you are aged 18-64 when you apply, you must also pass the Life in the UK Test and meet the English language requirements.

Requirement of continuous residence:

Continuous residence is defined as the period of time you are in the UK, which should be 5 or more years, unless you wish to apply for accelerated settlement. You must not have left the UK for more than 180 days a year during your 5 year continuous residence.

Applying with family members:

Your partner and/or children under 18 can be included in your settlement application, providing they meet the eligibility requirements.

How to apply:

You can apply with form SET(O) either online or via postal order. You may also use a premium service centre for postal orders. The documentation you will need to provide will be outlined on the form and may vary depending on your circumstances.

A postal order application costs £2,389 for you and an additional £2,389 per dependant, if any.

You will be contacted within 6 months if your application has been successful; however, this may take longer if your application is particularly complex.

Refusal of Tier 1 (Entrepreneur) settlement application:

Your application may be refused for various reasons, such as:

• A criminal record in the UK or elsewhere
• Providing false or incomplete information to the Home Office
• Breaking UK immigration law
