Curtailment of Leave to Remain Solicitors

Curtailment is when the Home Office cuts your existing permission short before its original expiry date. If you have received a notice, you may have only a short period to switch visa, challenge the decision or leave the UK.

What is curtailment of leave?

Curtailment, now often referred to in Home Office guidance as cancellation or shortening of permission, means your existing visa is brought to an earlier end. This is not the same as refusing a new application. It changes the permission you already hold.

If you do nothing before the new expiry date, you may become an overstayer. That can affect future visa, ILR and citizenship applications.

Common reasons leave is curtailed

Sponsor licence problem
Your employer or education provider loses, surrenders or has its sponsor licence revoked.

Employment or study changes
Your sponsored work or course ends, changes or is reported incorrectly.

Family relationship breakdown
The basis of a family visa may no longer exist after separation or changed circumstances.

Alleged breach or deception
The Home Office alleges false information, non-compliance or breach of visa conditions.

The 60-day window is short

Where permission is shortened to 60 days, you may need to secure a new sponsor, prepare a fresh application or challenge the decision before time runs out. Do not wait until the final week.

Frequently Asked Questions

How long do I have after curtailment?

Many curtailment decisions reduce permission to 60 days, or to the time left on your visa if that is shorter. The date on the notice matters, so take advice as soon as you receive it.

Can I appeal a curtailment decision?

There is usually no ordinary appeal just because leave has been curtailed. Depending on the facts, administrative review, a new application or judicial review may be available.

My sponsor lost its licence. What happens to my visa?

If your sponsor licence is revoked or surrendered, the Home Office may curtail your permission. You usually need to find a new sponsor, switch route or leave before the curtailed permission expires.

Can curtailment affect ILR or citizenship?

Yes. If curtailment leads to overstaying or gaps in lawful residence, it can affect later settlement and nationality applications. It should be handled before the deadline expires.

Do not let a curtailment notice expire

We can review the notice, calculate your deadline and advise on switching, challenge options and the steps needed to protect your status.
