Child Born in the UK During a Graduate Visa: New Dependant Rule from 3 August 2026

Quick answer

From 3 August 2026, a child born in the UK to a parent who holds existing Graduate route permission can apply as that parent’s dependant. If the application succeeds, the child is granted permission in line with the Graduate parent.

The change closes a gap in the previous Rules. It does not give the child permission automatically, it does not make the child British and it does not turn the Graduate route into a settlement route.

What changed in Appendix Graduate

Statement of Changes HC 259 added paragraph GR 9.4A(d). It permits a dependant-child application where the applicant is a child born in the UK to a Graduate who holds existing permission to stay in the Graduate route. The accompanying Home Office memorandum explains that the purpose is to provide a clear rules-based route for this small cohort.

The amendment applies from 3 August 2026. It aligns the child’s permission with the Graduate parent without opening the route to new overseas dependants.

The child needs an application. Being born in the UK does not itself grant immigration status or British citizenship. A UK birth certificate records the birth and parental details; it is not immigration permission.

Who the new rule is for

The focused rule is for a child who:

  • was born in the United Kingdom;
  • is applying as a dependant child under Appendix Graduate;
  • has a parent who currently holds Graduate permission; and
  • otherwise meets the relevant validity, suitability and dependant requirements.

The wording is tied to a Graduate who holds existing permission. Families should check the parent’s expiry date and apply in enough time for the child’s position to be considered before the parent’s leave ends.

Who the change does not cover

It does not create a general right for a child living overseas to join a Graduate in the UK. Existing Graduate dependant rules remain restrictive: a partner or child will normally need to have held permission as the person’s Student dependant, subject to the specific UK-born child provision.

It also does not grant the parent extra time. The child’s permission is granted in line with the parent, so the remaining period may be short if the parent is close to the end of Graduate leave.

Documents and information to prepare

The correct evidence depends on the family circumstances, but a careful application is likely to address:

  • the child’s full UK birth certificate;
  • the child’s passport or travel document, where available;
  • the Graduate parent’s passport and eVisa/status evidence;
  • the parent’s Graduate permission expiry date;
  • evidence of the child’s relationship with the parent or parents;
  • the other parent’s identity, immigration position and consent where relevant; and
  • any explanation needed where names, addresses or parental details differ.

Do not assume that the online form will resolve a complex other-parent or safeguarding issue without evidence.

Timing and travel

Consider the parent’s expiry date, whether another route switch is planned and whether the child needs to travel. Leaving the UK without a clear status and travel strategy can create practical and immigration complications. Take advice before making non-refundable travel arrangements.

Does the child become British?

Not solely because of birth in the UK. British citizenship at birth depends on the status of a parent at the time of birth and other nationality rules. A child who is not British may have later registration options in some circumstances, but those are separate from a Graduate dependant application.

Does this lead to settlement?

No. Appendix Graduate is not a settlement route. The child’s permission is in line with the Graduate parent. The family may later need to switch into a route that can lead to settlement, subject to that route’s requirements.

How the parent’s remaining permission affects the decision

A non-doctoral Graduate normally receives two years if the application was made before 1 January 2027, and 18 months if made on or after that date. A doctoral Graduate receives three years. The child does not obtain a fresh period counted from the child’s decision; the policy intention is permission in line with the parent.

Where the parent is approaching the end of Graduate leave, compare a standalone dependant application with the family’s planned switch into another route. The correct sequence can depend on the proposed work route, the other parent’s status, travel needs and whether all family members can meet the later route’s requirements.

The other parent’s position

The online application and the wider dependant rules may require information about both parents. Prepare an accurate account of who has parental responsibility, where each parent lives and whether consent is available. Separation, sole responsibility, a court order or safeguarding concerns should be addressed with appropriate evidence rather than omitted.
