EUSS Administrative Review

If your EU Settlement Scheme application has been refused, it is important to check the decision letter carefully before deciding what to do next. The old administrative review route for new EUSS decisions is no longer available.
GOV.UK states that new applications for administrative review of an EU Settlement Scheme decision are no longer accepted. Applications for administrative review submitted on or after 4 April 2024 will not be considered. Older valid administrative review applications made before that date may still be waiting for a decision.
What this means if you have an EUSS refusal now
For most current EUSS refusals, the immediate question is not whether to request an administrative review. The practical issue is whether you have a right of appeal, whether a fresh EUSS application is possible, or whether another immigration route should be considered.
The correct step will depend on the refusal reason, your residence history, your family position, your evidence and any deadlines in the decision letter. Some EUSS cases are time sensitive, especially where the refusal affects work, rent, travel, benefits or family life in the UK.
Possible options after an EUSS refusal
- Appeal: some EUSS decisions may carry a right of appeal. The deadline depends on whether you are inside or outside the UK and the wording of the decision letter.
- Fresh EUSS application: in some cases, it may be better to make a new application with stronger evidence, if the rules allow it.
- Alternative immigration route: where EUSS is no longer realistic, another family, work, private life or human rights route may need to be considered.
- Evidence review: refusals often turn on gaps in residence, relationship evidence, identity evidence or the timing of the application.
